New USPTO Artificial Intelligence Tools Aim to Enhance Trademark Search, Classification, and Application Accuracy

We had the pleasure of attending the United States Patent and Trademark Office’s (USPTO) AI update session today, and on the trademark side, the USPTO focused on practical tools, cautious rollouts, and a strong focus on integrity of the trademark registers. 

The primary tool addressed was the Class ACT (Trademark Classification Agentic Classification Tool). Launched on March 19, 2026, this tool provides AI-assistance for determining international class assignments, design search codes, and pseudo marks. As of April 23, 2026, the USPTO expanded its functionality to assist with mark descriptions and color claim capabilities. In short, the tool now addresses many of the back-end tasks that traditionally slow down the process and is quickly becoming embedded in how filings are prepared. At the same time, an image-based search function rolled out, which could meaningfully change clearance strategies for logo-heavy filings. Keep in mind, the image-based search function is currently only available through a MyUSPTO account.

Notably, AI tools have not made its way officially to trademark examining attorneys yet. While the USPTO has tested an internal LLM, any rollout is said to expected to be slow, deliberate, and closely monitored. In the meantime, training programs and internal governance structures are being built out to manage this shift. 

Furthermore, the agency stated they are actively monitoring court decisions and legislation, while aligning with broader federal guidance on AI and IP.

Overall, the update emphasized the integration of artificial intelligence efficiencies while maintaining the integrity of the trademark registers.
